Abstract:
The research aims to show that the crime of bribery is one of the worst scourges that afflict society, destroying its morals, and eliminating blessing from one’s money. It is one of the most impactful deviations that constitute a major crime in which three parties participate: the briber, the bribe-receiver, and the intermediary between them. The significance of this research consists in pointing out that the scourge of the spread of bribery is one of the problems facing peoples and individuals. It is a common affliction, the cause of many complaints, a problem that must be weighed on the scale of Sharia and dealt with correctly. Therefore, it has been necessary to use the method of comparison between schools of thought to extrapolate the sayings of jurists and explain how they deal with this scourge to overcome it. Hence arose the need for this study since the research done in this field is not commensurate with the size of the topic and its danger to the development and economy of countries. This research is an attempt to summarize the most important jurisprudential issues raised by both early and later jurists, and to establish preventive measures to limit this abhorrent phenomenon.
