Abstract:
This research aims to explain the role of Sharia (Islamic law) in building a mature awareness that enables individuals to confront the variables of reality. Commercial fraud is one of the moral crises that exists in every time and place, and transactions in Islam are governed by fixed rules and moral values. The research attempts to clarify the impact of rational awareness on confronting and eliminating commercial fraud by translating the teachings of religion into moral behavior for the members of society to follow. Imam Al-Ghazali said, “A callous conscience and deranged thought are not part of Islam in any way.” The research is limited to some jurisprudential issues related to the rulings and punishments related to commercial fraud, and the jurisprudential implications resulting from them. Due to the depth and comprehensiveness of the topic, the comparative, inductive, and deductive approaches have been used. The study mentions the evidence of jurists and discusses it, points out the preponderant opinion, while explaining the reason for the preponderance. One of the most important results of the research is that Islam focuses on ethics in its methods and objectives, and the absence of rational awareness is a fundamental reason for the emergence of various moral crises. Establishing the rules of the Islamic approach and its practical application will inevitably lead to correcting the moral, intellectual, educational, cultural and social defects among Muslims. Therefore, the researcher recommends the establishment of educational institutions to educate individuals about the importance of the moderate approach to religiosity without exaggeration or negligence.
