Abstract
The study aims to clarify the meaning of artificial intelligence (AI) and its importance in various aspects of our daily lives, as well as its role in the judiciary, highlighting how it accelerates case resolution and aids in the detection and documentation of crimes. This begins with the filing of lawsuits through smart litigation, the review of cases, the extent of the "smart judge's" authority, the issuance of enforcement decisions, and the implementation of judicial rulings using AI, ensuring that rights are not jeopardized. The study also addresses AI's role in the formulation and dissemination of fatwas, discussing both its advantages and disadvantages, along with the role of scholars in supervising this process and the religious regulations that govern it.The study also explores AI's role in managing personal status issues, such as the documentation of marriages, known as "smart marriages," which have seen remarkable success in reducing divorce rates and preserving marital bonds through the use of intelligent programs. Additionally, it examines programs like "Amica," which skillfully resolves divorce cases involving domestic violence in a peaceful manner, as well as the role of the smart expert in estimating alimony in disputed cases. Among the key findings: the use of intelligent systems in judicial enforcement falls under the principle of delegation, scholars must supervise AI usage in the drafting of fatwas, and digital marriage documentation is a step towards eliminating paper contracts.
