Abstract:
 
This manuscript is a nice thesis in explaining the conditions in which fasting and prayer are dropped for mukallaf (those who are bound to perform religious duties) according to the Hanafi school of thought. When fasting and praying are dropped for the mukallaf, an alternative is introduced which is the Fidya (ransom: amount of money paid in case of inability to fast). The writer provides proof of this from the Sunna. In addition to this, the writer refers to those who die and have not performed some of the prayers or the fasting, moreover, he mentions those whose excuse has ended and then died before performing what they missed. He states that the fatwa is different if the death is immediate to the end of the excuse, or whether it happens after a day of being healthy and able to perform fasting and praying. Another fatwa about the case of persons dropping fasting and praying on purpose and those who dropped them in negligence and obedience to the devil and whim. Then, the manuscript details the provisions of the ransom (fidya) due and its amount, and whether the value is enough or more actions are needed. The writer discusses the fatwa of using manumission to pay the fidya, and whether it is obligatory on the guardian or custodian. Another fatwa refers to the case if a person who missed prayers and fasting included the fidya in his will and the fatwa if the guardian pays the fidya without a will from the deceased, and that it is paid of one-third of the money, and the judgment if one-third of the money does not fulfill the payment of fidya.
