Abstract:
Many jurists have included numerous branches derived from grammatical rules in their books, among them Imam Muhammad Ibn Al-Hasan Ash-Shaybani, who derived in his book "Al-Jamea Al-Kabir" jurisprudential branches based on the linguistics systems of the Arabic language. Ibn Yaaish noted that Muhammad Ibn Al-Hasan included in his well-known book "Al-Jamea Al-Kabir" in the chapter entitled “Al-Ayman” (oaths) issues of jurisprudence based on Arabic linguistics systems that are only clear to those who have a solid foundation in this knowledge. This research compiles these rules to facilitate their access, enabling students to understand and benefit from the close relationship between the science of grammar and the fundamentals of jurisprudence. Additionally, it aims to help students practice the derivation of branches from Arabic grammatical rules.
This research adopts an inductive and analytical approach, tracking the jurisprudential branches derived from grammatical rules in the book "Al-Jamea" by Imam Muhammad Ibn Al-Hasan. It then analyzes these branches and connects them to the grammatical rules under which they fall. Several conclusions have been reached, including the necessity of learning Arabic sciences for those who wish to understand the Quran and engage in deriving rulings. Mastery of Arabic is a prerequisite for ijtihad (independent juristic reasoning). Many jurists have included numerous jurisprudential branches based on Arabic grammatical rules. Imam Muhammad Ibn Al-Hasan Ash-Shaybani includes jurisprudential branches based on Arabic linguistics systems in his book "Al-Jamea." The chapters of jurisprudential principles and most of its issues are largely based on the science of words inflection analysis. The appeal to grammatical rules in jurisprudential branches is as old as the differences in jurisprudential branches themselves.
