Medical Treatment of Defects Affecting the Continuation of the Marital Relationship
A Comparative Jurisprudential Study

Abstract:
The research aims to clarify the role of contemporary medical progress in the correction and treatment of defects that affect and disturb the purpose of the marital relationship. The research tries to explain the reasons for the treatment process; the most important of which is the presrvation of the marital relationship, ensuring that each of the spouses enjoys the other, and giving birth to healthy offspring. The comparative and descriptive approaches are followed. One of the most important results of the research is that the evaluation process is carried out only in accordance with Sharia controls. An example of this is the treatment of the defect of castration in a man, as it is required that the treatment here does not entail commiting a prohibited act such as the transfer of the testicle from a person to another because this process entails that the genetic traits being transferred from the transferer to the transferee; and later on to transferee's children, which is prohibited by law. When the marital defects are proven, the injured party has the right to request the option of lifting the damage, but in the event that they can be treated or corrected, the option is forfeited. The research also aims to indicate the methods through which the correction or treatment process is carried out, such as medicines, or through surgical operations. These two types of means are of great importance in the process of correcting the defects. On the other hand, who undertakes the process of treatment or correction is responsible for any criminal or financial liability that arises becuse of any error in the process, as every person is liable for the consequences of his work and any arising damage.
