Provisions for Documenting the Debt through Mortgage Contract
A Jurisprudential Study Compared to Kuwaiti Law

Abstract:
The Islamic Sharia is keen to document debts for the variety of prospected benefits arising from such process. Documentation maintains funds from loss by denial, and not being able to prove them. Moreover, the documentation cuts off the dispute between the dealers, as time is sufficient for one of the parties to forget the amount of the loan, so the denial is not out of being ungrateful, but forgetful. This is a reason for a dispute, then often documentation prevents such a dispute; because they refer to the documentation, which enables the parties to be confident of the truth. This research studies the provisions of documenting the debt by mortgage during and after the contract. It a jurisprudential study compared to Kuwaiti law. First, the study explains the issues in a simplified and adequate manner, and then shows the statements of jurists and mentions their evidence, and attributed them to their jurisprudential sources, with mentioning the face of significance, and discussing them. Then the study compares between the Kuwaiti law and the sayings of jurists and determines the points of agreement and disagreement. The main results in this research are: First, documentation by mortgage could be done during the contract and after it. Second, the mortgage becomes compulsive once the contract is sealed. Third, the possession of the mortgage is a condition of completion and stability of the contract. Fourth, the mortgage confirms the contract and binds it. Fifth, the mortgage does not belong to the mortgagee without the rest of the creditors except by possession.
