Asylum in The Light of the Sunnah

Abstract:
          This research aims to address asylum as a problem that has emerged and increased in recent times, its roots in the Quran and the Sunnah, and to clarify that this contemporary legal term has its counterpart in Islamic law, encompassing some meanings and even surpassing them, namely, migration, which is considered one of the forms of asylum. The research also aims to demonstrate that asylum is an authentic Islamic right, one of the noble virtues established in the pre-Islamic era and affirmed by Islam. The Prophet, peace be upon him, provided solutions and treatments that have not been surpassed until today, with the validity of these solutions for application in all times and places. The research also elucidates the rights and duties of refugees through the legislation enacted by the Prophet, peace be upon him, and the practical practices of the Companions, may Allah be pleased with them, as well as the endorsement of the Prophet, peace be upon him, for these practices. Additionally, it discusses who should not seek asylum, even if they are Muslims. An inductive and analytical approach was primarily followed. One of the most important findings of this research is the comprehensiveness of the Sunnah, as the Prophet, peace be upon him, provided a solution for any problem, whether it has occurred or not. However, texts should be carefully reviewed and interpreted in the contemporary context. Asylum is a right for the vulnerable in all times and places, provided they abide by the laws of the host country. By accepting refugees, they acquire rights and responsibilities similar to those of original citizens. They will not be a burden but a source of strength, just as the immigrants were in building the Al-Madinah alongside Al- Ansar.
