Abstract:
Islamic Sharia is concerned with Muslim woman in all aspects of life, and has guaranteed her rights as a daughter, a mother, or a wife. The Prophet, peace be upon him, instructed men to treat women well. This research, discusses the Islamic Sharia’s care for the emotional aspect of women in the Chapter of family jurisprudence. The research is divided into a preamble and three topics, the preamble discusses the meaning of feelings and the status of women in Islam. The first topic discusses the care of Islamic Sharia about the emotional side of women under the Chapter on marriage. The second topic discusses the same concept under the chapters of the dowry , Khul’[1], divorce, Oath of Separation, and custody. The research follows both the deductive, inductive, and comparative approaches. I concluded that Islam takes care of women's feelings in the chapter on marriage. It considered the virgin's silence as a sign of consent, forbade the gathering of wives in one dwelling in order to prevent arousing their jealousy, and forbade the tyranny of guardians when a woman desires a compatible marriage. Islam legislated mut'ah[2] and made it obligatory in some cases, and desirable in other cases to redress the pain of separation for the woman. The Islamic Sharia permitted khul’ as a measure to be taken by women comparable to the right of divorce granted to men when reconciliation is not possible. The sharia prohibited divorce during menstruation, gave the women the right to ask for Annulment of the Separation Oath, and gave priority to the mother’s right to custody. Moreover, woman's right to refuse husband's accusation of adultery is granted (Mulaana).
