Abstract:
The research aims at clarifying the right of usufruct on the public road, the obligation to preserve it, the appropriate penalty of its infringement, the guarantee of any assault, and when the guarantee is annulled. The research follows the analytical approach.  One of the most important results of the research is that the usufruct right of public utilities is granted but not the right of ownership of the utility. The right to use the street is a natural right for every person who benefits from it by selling and passing through; but on the condition of causing no harm, and any person has the right to file a lawsuit for infringement on public roads. The governor may cut off a place in the street for sale, as well as prevent the sale in it if it becomes a phenomenon that harms society and hinders traffic such as street vendors and others who offer their goods in front of the shops. The governor is entitled to prevent road occupancy and specify the appropriate punishment that varies according to the public facility and its nature. The infringement on the road has a specified punishment. The occupancy of the road through selling or others is left to the discretion of the judge, he specifies the punishment which may be imprisonment, closure of the shop or confiscating the goods.
