Transplantation of the pig's heart in the human body - between Islamic jurisprudence and modern medicine

Abstract:
The research aims to show that doctors’ opinion is the referent and base in medical religious issues but with conforming to the Shariah - legal rules and regulations that medical professionals do not deviate from. The research highlights the opinion of contemporary scholars regarding the operation. It follows the inductive and deductive approach, by tracking and extrapolating the opinions and evidence of the ancient and contemporary jurists, mentioning their evidence and their discussions in jurisprudential issues and the interpretation and comparison of those opinions to elicit the most correct opinion supported by evidence in Islamic jurisprudence. The research includes a definition of search terms and two sections. The first topic includes a statement of the considerations of impurity and non-impurity of the pig, heart transplantation and the similarities and differences between the pig’s heart and the human heart, preparing the pig for implantation of  its heart in the human body. The second topic deals with the Shariah judgement regarding the operation and the legal and medical warnings contained in this process. One of the most important findings of the research is that there is a similarity between the structure of the pig’s heart and the human heart, with a difference in genes. Therefore, the pig from which the heart is transferred is subjected to genetic modifications from specialists to overcome these differences and thus reduce the response of the human immune rejection when transplanted in humans, this process is permissible only in case of necessity, and the absence of the damages resulting from this operation. Such process should be referred to experts from among the honest and trustworthy doctors, and this is done according to Shariah regulations and not freely permissible.
