Abstract:
The hymen is a proof and symbol of the chastity of the virgin Muslim woman who has never been married and with which families are proud. This research aims emphasizing the importance of informing the suitor of the rupture of the hymen before the marriage contract in order to prevent forbidden fraud, and it also aims to show the negative impact of concealment in the case of the rupture of the hymen through an illegal relationship or because of another reason. The research relies on the analytical, descriptive, and comparative methods.
The most important findings of the research include the following: the hymen has a social and religious value, and its preservation is evidence of honor, and the society, according to the prevailing custom in it, suffers from a number of mistakes, a number of crimes that were never to happen began to take place such as killing the souls that God forbids killing. The concealment of the loss of the virginity for the suitor is an act of cheating and deception. This act may cause the suitor harm if the marriage takes place, and Islamic law forbids harm in all its forms.
