Abstract:
Telemedicine is one of the most important contemporary issues, and since it is related to human health that the Shariah urges to preserve, the present study finds it necessary to address this topic, show its pros and cons, and discuss its cases. The study aims at providing the rulings that are related to this kind of medical treatment and studying them jurisprudentially to relate it to its base. It also aims to show the importance of the science of jurisprudence, and to assert that Sharia is valid for every time and place, and for every situation, and that its general texts and rules expand to clarify the ruling of new cases in each era. It adopts an analytical, descriptive, and comparative approach. Among the most important conclusions of the study is that telemedicine is legally permissible when its conditions are met; it is permissible to take fees for it in any way that is agreed upon between the two parties; layman and unprofessional persons are prohibited to diagnose and treat diseases via modern telecommunication without resorting to specialists and they become sinful if they do so. Also, they guarantee the damages occurring to the patients as a result of their diagnosis.
