Abstract:
The present study tackles an important topic that subserves the Holy Quran and Sunnah; that is “Fiqh of hadith” from a jurisprudential and ta’sili perspectives. Fiqh of hadith is concerned with deducing judgments from Quran and Hadith as the Quran and Sunnah are the main subjects of most of jurisprudential rulings. The study seeks to investigate the efforts of Hadith scholars in Jurisprudence, their approach, and to draw attention to the Fiqh of hadith and its meaning, importance, general and special precepts, and the Muslims’ need to understand the aims of the fiqh of hadith, its legal rules and linguistic meaning through a jurisprudential and ta’sili study. The study adopts the following approaches: the descriptive approach: to describe and define all terminologies related to the fiqh of hadith; the inductive approach: to collect everything relating to fiqh of hadith; and the analytical approach: to analyze everything that is related to fiqh of hadith. The study reaches the following conclusions: the meaning of fiqh of hadith is to deduce meanings and legal rules through lexical items in accordance to the rules of Islamic jurisprudence. The study also explains the difference between two titles describing scholars: ‘Al-faqeeh al-mohadith’ and ‘Al-mohadith Al-faqeeh’, as the first has more knowledge in jurisprudence than Hadith, and the later has more knowledge in Hadith than jurisprudence. Moreover, it has illustrated that the importance of the fiqh of hadith is shown through delving deeper into the chain of narration of hadith and the text of hadith. Its importance also lies in refuting a claim that hadith scholars’ work is limited to collecting hadiths in one place.
