Abstract:
It is well-known that disagreements between the Sunni and the Mutazilah occur in many issues, most important of which is the attribute of Allah’s Justice and this is one of the five principles of Mutazilah. Hence, the present study examines some of the jurisprudential issues resulting from the disagreement over the attribute of Allah’s Justice and the impact of this disagreement between the Sunni and the Mutazilah on these issues. In order to do so, the study adopts the inductive and deductive approach and it reaches a number of conclusions as follows. It shows that theology impacts the science of the principles of fiqh; the status of reason is great in Islam on condition that this is in line with the light of Sharia so that it cannot be deviated and lost as is the case with the group of Mutazilah. They view the attribute of Allah’s Justice from the perspective of mere reason away from the Quran and the Sunnah. They believe in the mental beauty and ugliness and that people create their actions. They say that Allah must do the good and best action for people. All this is in contradiction to the Sunni. The study shows that these disagreements result in the Mutazilah’s belief that it is not allowed to prohibit one of two things as prohibiting one of them proves the ugliness of both of them. The Mutazilah also views that it is not permissible to abrogate a ruling by its opposite as they think this is absurd and the purpose of worship is not achieved by it. In this way, they contravene the view held by the majority of the scholars of jurisprudence of the Sunni.
