الملخص :

يتناول هذا البحث مفهوم الضرب التأديبي في الشريعة الإسلامية، مبينا أنواعه ومقاصده، ومجال تطبيقاته مع ذکر جملة من الضوابط المنصوصة والمستنبطة لاستعماله. هادفا إلى إبراز النظرة المتوازنة لهذه المسألة التي کثر الخوض فيها، فلا إفراط في الضرب يخرجه عن حد التأديب والإصلاح إلى الاعتداء والحيف والإيلام، ولا تفريط بالمنع منه مطلقا، فتنشأ الأجيال في الأمة لا تهاب کبيرا، ولا تحترم قانونا، ولا يردعها رادع. وقد اعتمد البحث على المنهج الوصفي القائم على الاستقراء والتحليل والاستنباط، ومن أهم النتائج التى توصل البحث إليها : أن الأصل في الضرب المنع، وأنه يباح من الضرب ماکان بقصد التأديب کالأب مع ابنه، والزوج مع زوجته حال النشوز.

Beating as a Discipline Strategy: A Legal Disciplinary Regulatory Vision

Abstract:

The present study investigates the concept of disciplinary beating in Islamic Sharia’. It shows its types, purposes, and field of application. It states a group of stipulated and inferred regulations on the use of beating. It aims to highlight the balanced view of this issue that is frequently discussed: beating is not meant to be excessive; Excessive beating goes beyond the limit of discipline and reform and comes closer to assault, injustice, and pain. On the other hand, it is not recommended to abandon beating altogether because generations in Ummah will grow up neither respecting older people, nor respecting laws, and will be affected by no deterrent. The study adopts the descriptive approach that is based on induction, analysis, deduction. The most important conclusions arrived at include the following: the norm is to forbid beating. It is allowable to beat with the intention of discipline as in the case of a father beating his son, and a husband beating his disobedient wife.
